These Terms of Use govern access to and use of the DailyDish application, its features, the website www.mydailydishapp.com, and any associated service.
The Service is operated by OrbitalBay, which can be contacted at: mydailydishapp@gmail.com.
By creating an account, using DailyDish or continuing to use the Service, you accept these Terms. If you do not accept them, you must not use DailyDish.
1. Purpose of the Service
DailyDish is a personal recipe book that allows users to create, organize, save, analyze and view their recipes. The Service may allow the analysis of texts or images voluntarily provided by the user in order to generate or complete a recipe card.
DailyDish does not provide any scraping feature, automated URL import, automated collection from third-party websites or circumvention of access restrictions. Content analyzed by DailyDish is provided directly by the user.
2. User Account
Certain features require the creation of an account. You agree to provide accurate information and to keep your login credentials confidential. You are responsible for any activity carried out from your account, except in cases of fraudulent use not resulting from your fault.
You may request deletion of your account according to the methods provided in the application or by contacting us at mydailydishapp@gmail.com.
3. User Content
“User Content” means all content that you create, import, enter, analyze, save or share through DailyDish, including recipes, texts, images, photographs, notes, titles, ingredients, instructions and content generated from your imports.
You retain ownership of your User Content. DailyDish does not claim any ownership rights over this content.
4. DailyDish as Technical Hosting Provider
For User Content, DailyDish acts as a technical hosting provider. Content is stored at your request, in your personal space, in a manner comparable to personal storage space.
DailyDish does not select the content you import, does not publish it on its own initiative and does not exercise generalized prior editorial control. However, DailyDish may remove, block or disable access to any content or sharing link reported as unlawful, contrary to these Terms or infringing the rights of third parties.
5. Technical License Granted to DailyDish
You grant DailyDish a limited, non-exclusive, worldwide, free license strictly necessary for the operation of the Service, in order to host, save, synchronize, analyze, technically process, display and return your User Content in the application.
When you activate a sharing link, this license includes only the right to make the relevant recipe accessible to people who have that link. DailyDish does not exploit your User Content for commercial purposes independent of the Service without your consent.
6. Rights to Imported Content
You are solely responsible for the content that you add, import, analyze, save or share through DailyDish. You warrant that you have the necessary rights, authorizations or legal bases to use this content in the Service.
In particular, you agree not to import, copy, save, analyze or share texts, images, photographs or recipes protected by third-party rights if you do not have the necessary rights or authorizations.
7. Analysis of Texts and Images
DailyDish may analyze the texts and images you provide in order to extract or suggest recipe information. Results may be incomplete, inaccurate or require manual correction.
You remain responsible for verifying generated or completed recipes, including ingredients, quantities, allergens, cooking times, temperatures, nutritional values and food safety instructions.
8. Sharing by Link
You may choose to share certain recipes by means of a link. Anyone with this link may access the shared recipe. You are responsible for your decision to share a recipe and warrant that you have the necessary rights to all elements it contains.
You may disable a sharing link at any time. DailyDish may also disable a link, remove content or restrict access to a shared recipe in the event of a report, complaint, alleged breach of these Terms or infringement of third-party rights.
9. Prohibited Uses
You agree not to use DailyDish to:
- violate intellectual property rights, image rights, privacy rights or other third-party rights;
- import or share unlawful, misleading, defamatory, violent, hateful, dangerous or abusive content;
- circumvent technical measures, access restrictions or terms of use of third-party services;
- attempt to access another person’s account, data or systems;
- disrupt, copy, resell, disassemble or abusively compete with the Service.
10. Reporting and Removal
If you believe that content accessible through DailyDish infringes your rights or is unlawful, you may contact us at mydailydishapp@gmail.com with: identification of the relevant content, the link or information allowing it to be located, your contact details, the rights invoked, and a good-faith statement explaining the reason for the report.
DailyDish may remove or disable access to the relevant content, request additional information, inform the user concerned where permitted by law, and take any appropriate measure in the event of repeated or serious violations.
11. DailyDish Property
The application, the DailyDish name, logos, interfaces, graphic elements, official texts, technical databases, software, features and trademarks associated with the Service belong to OrbitalBay or its licensors. No rights are granted to you over these elements other than the limited right to use the Service in accordance with these Terms.
12. Subscriptions and Payments
Certain features may be paid or accessible by subscription. Purchases, renewals, cancellations and refunds made through Apple’s App Store or Google Play are subject to the rules of the relevant store, in addition to applicable laws.
You can cancel your subscription from your Apple or Google account settings. Deleting the application does not necessarily cancel the subscription.
13. Availability, Modification and Discontinuation of the Service
DailyDish reserves the right to modify, suspend or discontinue all or part of the Service, temporarily or permanently, including for technical, security, legal, economic or operational reasons.
Where reasonably possible, DailyDish will inform users in advance. In cases of emergency, legal obligation, security risk or force majeure, the Service may be suspended without prior notice.
If a permanent interruption affects an ongoing paid subscription, the user’s possible rights will be handled in accordance with applicable law and the rules of the relevant application store.
14. Suspension and Termination
DailyDish may suspend or delete your account, disable content or limit access to the Service in the event of a breach of these Terms, risk to the Service, legal request, third-party complaint or abusive use.
You may stop using DailyDish at any time and request deletion of your account.
15. Liability
DailyDish is provided “as is” and “as available”, to the extent permitted by applicable law. DailyDish does not guarantee that the Service will be permanent, error-free, available without interruption or suitable for all specific uses.
DailyDish does not provide medical, nutritional, dietary or professional advice. You are responsible for verifying recipes, ingredients, allergens, quantities, cooking instructions and information generated or stored in the application.
No clause of these Terms limits the mandatory rights you may have as a consumer under applicable law.
16. Indemnification
To the extent permitted by applicable law, you agree to indemnify DailyDish and OrbitalBay against any claim, loss, damage, liability or reasonable expense resulting from your User Content, your sharing of recipes, your breach of these Terms or infringement of third-party rights.
17. Third-Party Services
DailyDish may depend on third-party services, including hosting, analytics, payment, artificial intelligence services, Apple App Store or Google Play. DailyDish is not responsible for interruptions, terms or decisions specific to these third-party services, unless otherwise required by law.
18. Personal Data
The processing of your personal data is described in our Privacy Policy. This policy explains in particular what data is collected, why it is collected, how long it is retained, and how to exercise your rights.
19. Changes to the Terms
DailyDish may modify these Terms. In the event of a material change, we will inform you by reasonable means. If you refuse the new Terms, you must stop using the Service.
Continued use of the Service after the new Terms come into effect constitutes acceptance, except where the law requires explicit consent.
20. Governing Law and Disputes
These Terms are governed by the law applicable to OrbitalBay’s registered office or place of establishment, subject to the mandatory protections that consumers may benefit from in their country of residence.
